#EndPoliceBrutality: LEGALITY OF STOP AND SEARCH BY THE POLICE

In times like this our victory does not end in the #endsars protest, but it begins when we get acquainted with our laws and apply them circumspectly.


It is no doubt that Nigerians for the first time remarkably have marry their grievances with positive actions which is an indication that the people cannot be taken for a fool anymore. In times like this it is germane for we all to know the legality of STOP AND SEARCH BY THE POLICE, so it will guide our actions since it is almost inevitable to come across in Nigeria.

SECTION 50 (3) POLICE ACT 2020 PROVIDES THUS :

Before any search of a detained person or vehicle may take place , the officer shall give the person to be searched or in charge of the vehicle –

*His name and name of the police station he is attached to.

*The object of the search.

*His grounds or authorization for undertaking the search.

SECTION 50(4) POLICE ACT 2020 PROVIDE THUS :

*for any police officer to exercise the power to stop and search, he shall be on  uniform or wear visibly a valid police identity card.  

IT’S DUTIFUL FOR US TO KNOW THIS AND APPLY IT WHEN NECESSARY, RIGHTS ARE MEANT TO BE EXERCISED NOT TO BE IGNORED.
